The Validity of Seller-Imposed Conditions on Purchased Goods in Islamic Contracts #
Original Question: Can a seller impose conditions on me regarding the use of an item I purchased? For example, I bought a car, and the seller sold me the car with the condition that I am not allowed to drive it at a speed of more than 100km/h.
These kinds of safety conditions may seem acceptable on the surface. It, however, goes against muqtada ‘aqd (nature, implication, and objective) of a sale contract, which is the absolute transfer of ownership.
Therefore, once the goods have been sold, the buyer, as the new owner of the goods, is entitled to complete utility of the goods purchased. Any conditions that restrict the buyer from possessing or benefiting from the goods fully will invalidate the contract.
