FAQ #88: Who is liable for damages if a buyer purchases eggs, and some are broken during delivery?

Original Question: A buyer bought a hundred eggs from a seller. After an agreement was reached and payment has been made, the seller will deliver the goods to the buyer. During the delivery process, an accident occurred, which resulted in a few broken eggs. Who is liable for the damages?

When a sale and purchase agreement is completed, the seller is responsible for ensuring the safe delivery of the goods to the buyer.

Any damages that occurred before delivery should be rectified by the seller before delivery.

However, if the goods have been delivered, any adversity that happens after delivery is no longer the seller’s responsibility except for product defects found on the goods.
