Original Question: There are sellers who make a sale with certain conditions attached. For example, the seller said: “If Ahmad, who wanted to buy this item just now, did not come back; I will sell it to you, Abu.” Abu replied, “I buy it.”
Based on this situation, the sale and purchase agreements between the seller and Abu are not valid.
This is because a sale agreement is a transfer of ownership that requires assertiveness and clarity for it to be valid.
Thus, the agreement must be made again without such ambiguous conditions for it to materialize in shari’ah.
